This Privacy Policy regulates the treatment of personal data of users (hereinafter “User” or “Users”), collected during the use of the website www.texmb.com (hereinafter “Site”) by Marta F. B. Barros (hereinafter “TEX MB”), as the entity responsible for the treatment. The provision of personal data implies the knowledge and acceptance of the conditions contained in this Privacy Policy. This Privacy Policy and Cookies Policy is complemented by the Terms of Use.

COLLECTION AND PROCESSING OF PERSONAL DATA

Access to and use of the Site does not involve the provision of personal data by the User. However, the use of certain features of the Site, such as using our contact form, subscribing to our newsletter, registering as a customer or purchasing products on TEX MB’s online store, will require the provision of personal data. TEX MB is responsible for collecting and processing the personal data of Users of the Site, under the terms and for the purposes indicated in the applicable legislation on personal data protection.

YOUR RIGHTS AS A USER

Under the terms of the applicable legislation, the User may at all times exercise their rights in relation to the personal data concerning them:

  1. Right of Access: to obtain confirmation as to which personal data concerning him/her are being processed and to obtain a copy of the personal data being processed.
  2. Right of Rectification: to request that your personal data that are inaccurate be rectified or to request that incomplete personal data be completed.
  3. Right to Erasure: obtain the erasure of your personal data, provided there are no valid grounds for its conservation.
  4. Right to Limitation of Processing: to request the limitation of the processing of your personal data by requesting the suspension of processing or the limitation of the scope of processing to certain categories of data or purposes of processing.
  5. Right to Portability: to receive the data you have provided us with in a digital format for current use and automatic reading or to request the direct transmission of your data to another entity that becomes the new controller of your personal data.
  6. Right of Objection: to object at any time to a data processing, such as in the case of data processing for marketing purposes;
  7. Right to object to decisions based solely on automated processing: not to be subject to any decision based solely on automated processing, including profiling, which produces legal effects concerning you or significantly affects you in a similar manner.

In accordance with the law, the User is also guaranteed the right, by the aforementioned means, to withdraw their consent to the processing of data for the purposes indicated, whenever the processing is carried out on the basis of consent, not invalidating, however, the processing carried out until that date on the basis of the consent previously given. CONSERVATION OF PERSONAL DATA

The personal data collected are processed in strict compliance with the applicable legislation. Personal data shall be stored in accordance with the respective purposes and in compliance with the applicable legal time limits. Thus, and whenever there is no specific legal requirement, the data will be stored and kept only for the appropriate period and to the extent necessary for the scope of the purposes for which they were collected, unless the right to object, the right to erasure or the withdrawal of consent is exercised within the legal limits.

TEX MB may transmit your data to subcontractors for the purposes mentioned above, under the terms of the contracts concluded with them. In particular, for the purposes of processing your orders (through the Site or by email), or on the basis of your consent, TEX MB may communicate your data to third parties, such as: i) partners or suppliers with whom TEX MB establishes commercial relations; and ii) financial and payment institutions. TEX MB uses its best efforts to protect the personal data of users against unauthorized access over the Internet. To this end, TEX MB uses security systems, rules and other procedures to ensure the protection of personal data, as well as to prevent unauthorized access to data, improper use, disclosure, loss or destruction. It is, however, the responsibility of Users to guarantee and ensure that the computer used to access the Site is adequately protected against harmful software, computer viruses and worms. Additionally, Users should be aware that, without the adoption of adequate security measures (for example, the secure configuration of the browser, updated antivirus software and not using software of doubtful origin), the risk of personal data being accessed by unauthorized third parties is increased.

COMPLAINTS

Without prejudice to any other administrative or judicial remedy, the User has the right to lodge a complaint to the competent supervisory authority under the law (in Portugal, the National Commission for Data Protection – “CNPD”) if he/she believes that the processing of his/her data by TEX MB violates the legal regime in force at any given time.
